Action Taken Under Delegated Authority (Significant Operational Decision): Reinstatement of Taxi Fee Post Constitutional Change

An unintended consequence of the Licensing Committee Functions (Function A) within the Constitution (prior to revision by Full Council on 19/07/23) created a conflict which means that all decisions relating to fees and charges for licensing functions are required to be made at Licensing Committee regardless of the receipt of objections. This conflicts with current practice in relation to the review of fees and charges outside of the Budget set at Full Council.

 

An additional fee of £15 was included as part of the hackney carriage and private hire licence process to take account of additional regulatory and compliance checks required as part of the fit and proper test for individuals. Once the anomaly was identified, this fee was suspended and those who have already paid it will be refunded over the next 12 months.

 

On 20 July 2023, the Head of Community Services took the decision to reinstate the £15 fee from 1st October 2023, following the required revisions to the Constitution at Full Council on 19/07/23 and agreement from the Licensing and Governance Committees. Action Taken Under Delegated Authority (Significant Operational Decision): Animal Activity Licence - Arranger Fee

In common with all cat and dog boarding settings in a private residence, the Council as Licensing Authority visit, assess and score settings according to Animal Activity Licensing but in order to cover the additional regulatory requirements, the Council needs to address the issue of arrangers/franchise operations. These businesses will have their documentation assessed in principle as a business/franchise through whom host families are identified, operate under the principles of the said Arranger/Franchise Operation and where dogs are then boarded. The current Part A fee for a licence is £189.90 and this is the fee that is charged for Arrangers Licences as we need to recover the costs of administering the process. In addition, any changes to the Arrangers Licence, such as the addition of a host family or removal of the same/change of details will also need a fee as this does require administrative work and the production of new licence and associated documentation as £25.

 

Fees Proposed: 

Arrangers Licence (New) £189.90 

Arrangers Licence (Renewal) £110 

Change Of Details/Inclusion of Host £25.

 

On 27 July 2023 the Head of Community Services took the decision to approve the fees as set out. Further information on this decision can be found on the Council’s website.
