Action Taken Under Delegated Authority (Significant Operational Decision): Minor Amendments to the Whistleblowing Policy

At its meeting on 6 July 2022 the Cabinet approved the Council’s Whistleblowing Policy (FIN/574 refers) for adoption and publication and delegated authority to the Head of Corporate Finance (in consultation with the Leader) to review and make minor amendments to the Policy as further changes to legislation and statutory guidance are introduced. 

 

In line with that delegation, on 8 November 2022 the Head of Corporate Finance, in consultation with the Leader, made the following minor amendments to the Council’s Whistleblowing Policy to keep the Policy up to date:

 

·        Paragraphs 23 & 28. Rename the charity ‘Public Concern at Work’ to ‘Protect’.

·        Paragraphs 7,23 and 28. Change ‘in good faith’ to ‘in the public interest’.

·        The requirement is now that an employee must make a protected disclosure in the public interest rather than in good faith.

Action Taken Under Delegated Authority (Significant Operational Decision): Minor Amendment to the Anti-Fraud and Corruption Policy

At its meeting on 6 July 2022 the Cabinet approved the Council’s Anti-Fraud and Corruption Policy (FIN/576 refers) for adoption and publication and delegated authority to the Head of Corporate Finance (in consultation with the Leader) to review and make minor amendments to the Policy as further changes to legislation and statutory guidance are introduced. 

 

In line with that delegation, on 8 November 2022 the Head of Corporate Finance, in consultation with the Leader, made the following minor amendment to Section 2 Item 8 to keep the Council’s Anti-Fraud and Corruption Policy up to date:

Delete “All evidence gathering will comply either by the act being used the collect the information or by the Data Protection Act 1998. This is soon to be replaced by the EU General Data Protection Regulation (GDPR) from May 2018” and replace with “All evidence gathering will comply either by the act being used to collect the information or by the Data Protection Act 1998 which has now adopted the UK General Data Protection Regulations.”


This reflects that the Data Protection Act now includes all the GDPR changes.
