Action Taken Under Delegated Authority (Significant Operational Decision): Hawth Theatre to Return Back to Contract

In response to Covid-19, the Government required all theatres to close between 17 March 2020 and 14 August and again between 5 November and 1 December 2020.  A further lockdown was introduced 26 December 2020 until mid-April 2021.  The Hawth reopened late August under strict social distancing requirements resulting in significantly reduced audience capacities with many shows having to be cancelled or rescheduled into 2022.

 

PPN02/20 and PPN04/20 set out Government guidance for contracting authorities working with suppliers over the course of the pandemic.  The guidance encouraged contracting authorities to provide support for suppliers to ensure their continued existence and to enable services to be re-established once distancing measures were lifted.  The contract was suspended and replaced by a Deed of Variation (DOV).

 

During this time period the existing contract ended (February 2022).  Negotiations then commenced between the Council and Parkwood Leisure (PL) resulting in a four year contract extension being awarded commencing 1 February 2022 and finishing on 31 January 2026.  The contract extension was based on the terms of the original contract.

 

During the extension period a legal mechanism was put in place allowing either party to return back to contract, and moving away from Covid Relief support.

 

On 26 May 2022, the Head of Major Projects and Commercial Services, in consultation with the Cabinet Member for Wellbeing, approved that Parkwood Leisure return to contract.  Crawley Borough Council supports this decision as it will allow a return to the service specification.  Legal opinion has been obtained and approvals received.

 

Parkwood Leisure will retain all cost risk over the remaining period of the contract extension, irrespective of any re-introduction of a full lockdown or the continuance of any restrictions on distancing or capacity reductions.

Change in Membership Following Southgate By-Election

In accordance with Paragraph 2.1(o) of the Full Council’s Procedure Rules contained within the Constitution and in concurrence with the wishes of the political group, the Head of Governance, People & Performance has appointed Councillor Bob Noyce to fill the vacancies on the following Committees:

·         Licensing Committee.

·         Licensing Sub-Committee.

·         Economic Regeneration Working Group (ERWG).

·         Employment Panel (pool of Councillors).

·         Grants Appeal Panel (pool of Councillors).

 

These changes take immediate effect.

September Meeting Dates of the Governance and Licensing Committees

With the agreement of both Committee Chairs the dates of the scheduled meetings of the Governance Committee and Licensing Committee set out in the published Calendar of Council Meetings have been amended as follows:

·       Governance Committee moved from 12 September 2022 to 19 September 2022.

·       Licensing Committee moved from 19 September 2022 to 12 September 2022.

 

Please amend these dates in your diary.

Change in Division Name: Governance, People & Performance

The Council division currently known as Legal, Governance & HR has been renamed Governance, People & Performance.  This change has been made to ensure that the name better reflects all the teams, services and functions within the division.  It will help bring its people together, make them feel more included and hopefully encourage more knowledge sharing, cross-team working and collaboration. The Constitution and Sub-Delegation Schemes will be updated to reflect this change in due course.
