Action Taken Under Delegated Powers: Transfer of Section 106 Monies for Education

On 27 December 2019 Councillor P Lamb, as Leader of the Council, approved the transfer of Section 106 Monies to West Sussex County Council as the Local Education Authority as set out in report PES/340 as those monies had been received for the provision of education services.

Action Taken Under Delegated Authority (Significant Operational Decision): Town Hall Site Redevelopment: Contract Award

In February 2017, the Full Council agreed the deliverables of the Town Hall Site redevelopment, the budget lines to achieve this, and the delegated powers to develop and proceed with the development. A full options analysis was taken at that time.

 

The Town Hall Site Redevelopment has reached its next key milestone. Westrock have now agreed and completed a contract with Kier to deliver:

1.    Nine-storey building providing a modern new Town Hall on the first 3.5 floors plus 5.5 of Grade A commercial space that will generate income for future service delivery

2.    New public square for the town centre

3.    Refurbished and more secure car park.

 

The District Heat Network continues to progress, albeit more slowly that previously programmed.  It is intended that a contract is signed early this year, and a further report will be provided at that time.

 

Under the delegation approved by Full Council on 22 February 2017 (minute 89 refers), on 20 December 2019 the Deputy Chief Executive, in consultation with the Leader of the Council, the Head of Legal, Democracy and HR, and Head of Corporate Finance has:

·         Agreed that Kier are being appointed by Westrock to deliver the elements of the Town Hall Site Regeneration outlined above.

·         Ensured that the Council actively involved the appointment and the negotiation of the contract, in particular around continuity arrangements.

·         Agreed to a direct appointment rather than through a competitive process as the structure of the Council’s agreement with Westrock sits outside of OJEU procedures. In doing so the Council has ensured that this deal represents best value.

·         Ensured that the costs of the contract is at the budgets agreed, and includes a healthy contingency of around 10% of the total budget.
