Purpose:

The Whistleblowing Policy seeks to provide a process that gives anyone with a concern about the Council the confidence to bring that concern to our attention.

 

This Policy has been written to take account of the Public Interest Disclosure Act 1998 which protects workers making disclosures about certain matters of concern, when those disclosures are made in accordance with the Act’s provisions and in good faith. The Act makes it unlawful for the Council to dismiss anyone or allow them to be victimised on the basis that they have made an appropriate lawful disclosure in accordance with the Act.

 

Our current policy dated March 2018 has been updated to reflect the changes in department names and the changes in where further guidance can be sought.

 

Decision:

 

RESOLVED

 

That the Cabinet:

 

a)         approves the Whistleblowing Policy (Appendix A of report FIN/574) for adoption and subsequent publication.

 

b)         delegates authority to the Head of Corporate Finance, in consultation with the Leader,of the Council to review and make minor amendments to the Whistleblowing Policy as further changes to legislation and statutory guidance are introduced.

 

(Generic Delegation 7 will be used to enact this recommendation).

 

 

Reasons for the Recommendations

 

To fulfil the Council’s duty to review and publish a policy regarding the Whistleblowing and the Public Interest Disclosure Act 1998.
